Staff Seminar: Reforming the law relating to secured transactions in Mexico
Summary: The Commercial Code of 1889 did not allow a “bottoms up” approach to the development of commercial law in Mexico.  This, coupled with a civil law doctrine that limited the use of property rights, prevented the development of secured transactions.  Legal reforms have cleared these issues giving Mexico a system similar to the one in the US.

Summary: The current doctrine of unconscionability does not explain what it means to be unfair or the outcomes of cases we have at hand. The only hope in having a coherent doctrine is to explain unconscionability as violation of voluntary commutative justice as in Aristotelian tradition.
