On January 30, 2024, the government published the "Safeguarding National Security: Legislation under Article 23 of the Basic Law" public consultation document. This initiative aims to fulfill Hong Kong SAR's constitutional responsibilities by completing local legislation under Article 23 of the Basic Law in accordance with the National People's Congress's "5.28 Decision" and the Hong Kong National Security Law. The goal is to enhance legal systems and mechanisms for maintaining national security.
This local legislation is intended to effectively prevent, stop, and punish acts endangering national security, ensuring the protection of individual rights and freedoms, and securing property and investments within the Hong Kong SAR.
The consultation document proposes several measures, including refining the crime of treason under the Criminal Offenses Ordinance, adjusting the scope of incitement to defection, and introducing new offenses to prevent rebellious acts. It also suggests amendments to protect state secrets, combat espionage activities, and safeguard public infrastructure and computer systems.
